Dr. Francis Boyle, Professor as a leading Human Rights lawyer in International Law: what can you tell us about the Israel's bombardment on Gaza? Is the Netanyahu government committing war crimes?
To put this into comparison: in Bosnia the International Court of Justice ruled that the extermination of 7,000 Bosnian muslim men and boys at Srebrenica was genocide and I was the lawyer for the mothers of Srebrenica and Podrinja, and got the prosecutor for the International Criminal Tribunal for the former Yugoslavia, to indict the Yugoslav president Slobodan Milošević for two counts of genocide: genocide against Bosnia in general, and second, genocide for Srebrenica: 7,000 dead. Well we already have now 11.500 (the actual: 17.997) the official figures coming out of Gaza. If you read the Nürnberg Charter for the prosecution of Nazi leaders it clearly says a Nürnberg War Crime is, quote: “wanting destruction of cities, towns or villages”, unquote. Clearly that is what Israel has done all up and down Gaza from October 8th; and then a Nürnberg Crime Against Humanity is defined as “murder extermination and other inhumane acts committed against any civilian population”.
Now that Crime Against Humanity then, was turned into the Genocide Convention itself. The Genocide Convention provides acts of genocide and here, let me quote: “killing members of the group” -well now we have 11.500 (17.997) dead Palestinians- “causing serious or bodily or mental harm to members of the group, deliberately inflicting on the group conditions of life, calculated to bring about its physical destruction, in whole or in part”.
That is exactly what Israel has done to them. Goings we have an israeli General publicly stating, “there will be no food, no water, no fuel, no humanitarian relief supplies at all to the people of Gaza”. Certainly that is deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part.
I would also point out Israel is a party to the Genocide Convention. The state of Palestine is a party to the Genocide Convention. The United States government is a party to the Genocide Convention.
And here Article 3E of the Genocide Convention condemns and criminalizes complicity in genocide. And I regret to say, in the Biden administration, that is what we are seeing: the United States government being complicit in the israeli genocide against the Palestinians. These are Nazi crimes, the bombardment of Gaza.

There have been no good faith negotiations by Israel with the Palestinians over Two-States Solution, and as a matter of fact, the United States government has always supported Israel against the Palestinians at these so called “Peace Negotiations”.
I was there for two years as the legal advisor to my client and friend the late great Dr. Haidar Abdel Shafi -from Gaza- for the Middle East Peace Negotiations, and the United States State Department officials later admitted -by the way all three of whom were Jewish- later admitted that they served as Israel's lawyer.
Tony Blinken today is a died hard zionist. He admitted that when this crisis flew over, he flew over to Israel and said: “I am a Jew and I am here as a Jew”… so that is what you're facing. You can't believe anything coming out of the State Department, that for sure.
The United States traditionally backs Israel, as you said Professor. Is that the only reason that Biden Administration support Israel wholeheartedly now, like giving a blank check? The International Court of Justice has ruled that the Palestinians had a right for self-determination, which is correct. And exercising that right of self-determination in the Palestinian Declaration of Independence, and I advised on pursuant to the instructions of chairman Yasser Arafat they accepted a Two-States Solution in the Palestine National Council meeting in Algers: it's in there if you read it. The Palestinians have fruitlessly tried to negotiate a Two-State Solution since November 15th1988, and the Americans know it, and they've done absolutely nothing to promote it. All this talk by Tony Blinken is eyewash, they've done nothing. The Americans haven't done didly squat. We could have had peace in 1989 if the Americans and design is really wanted to peace. tThat being said it is still the official position of the Palestinian people exercising their right to self-determination: two states based on resolution 181, not 247 but 181, with a a shared capital for Jerusalem. That is their position. I honor and respect that position. And until the Palestinians changed their mind, I respectfully submit that. The rest of us should too.
The crisis and the Israeli attacks on Gaza reminded the world that the United Nations Security Council is a paralyzed body: the council repeatedly failed to fulfill its responsibility, which is to maintain peace and security. As it failed to accept a resolution on ceasefire what do you make of it?
It's the power and domination of the uh United States and the zionist lobby that is preventing all this. It is the United States has always stood with Israel at the Security Council. But I will point out that under the Uniting for Peace Resolution passed by the UN General Assembly in 1950, when the US exercises its veto power at the security Council, it can be turned over to the UN General Assembly to take take steps of enforcement against Israel. For example the General Assembly could recommend comprehensive economic sanctions against Israel; the General Assembly could suspend Israel from participation in the activities of the General Assembly as they did to the criminal appartheid regime in South Africa; and also as they did to the genocidal Yugoslavia for inflicting genocide against the bosnians, which is directly on point. The General Assembly could set up an International Criminal Tribunal for Israel to prosecute Israel for crimes, as a subsidiary organ under Article 22 of the United Nations Charter. There are a variety of steps that can be taken by the General Assembly under the Uniting for Peace Resolution, yes.
